
The Bar Council of India (BCI) has clarified that foreign lawyers and law firms are not permitted to appear in Indian courts, tribunals, or authorities. According to the amended rules introduced in 2022, foreign lawyers cannot practice Indian law or provide legal advice within the country. The BCI’s fresh press statement emphasizes that foreign legal practitioners are restricted to advising on the laws of their respective countries and only in non-litigation matters.
The BCI reiterated that foreign lawyers and firms can only operate in India on the principle of reciprocity, meaning they may practice their country’s legal system in India only if Indian lawyers are permitted to do the same in those countries. Furthermore, foreign lawyers cannot set up offices or practice Indian law without approval from the relevant Indian ministries.
BCI believes these regulations will benefit Indian lawyers and youth, particularly by redirecting international commercial arbitration cases back to India. Previously, many of these cases were conducted abroad, causing economic loss to the Indian legal community. Now, arbitration cases will be handled domestically, which will not only support local lawyers but also boost the Indian economy.
If any foreign lawyer or law firm is found engaging in litigation or unauthorized legal activities, the BCI will take strict action, including expulsion and cancellation of registration. The BCI is also consulting on further guidelines to strengthen the Indian legal profession. (ANI)
