
Lucknow (Uttar Pradesh) [India], April 19 (ANI): In the midst of growing tensions between the judiciary and legislature, Bharatiya Janata Party (BJP) leader Dinesh Sharma on Saturday asserted that the President of India holds unquestionable authority, stating, “No one can challenge the President, as the President is supreme.”
Speaking to ANI, Sharma referenced the Constitution to support his claim. “There is an apprehension among the public… When Dr. BR Ambedkar wrote the Constitution, the rights of the Legislative and Judiciary were clearly written. According to the Constitution, no one can direct the Lok Sabha and Rajya Sabha, and the President has already given her assent. No one can challenge that,” he said.
His remarks echo and follow controversial statements made earlier in the day by BJP MP Nishikant Dubey, who strongly criticized the Supreme Court. Dubey alleged that the apex court was overstepping its mandate and accused it of “inciting religious wars.” He even questioned the relevance of Parliament if the court continues to take on a legislative role.
Dubey further pointed to past decisions by the court, including the decriminalization of homosexuality, as examples of judicial overreach. “There was Article 377… Homosexuality was a crime. Suddenly, the Supreme Court abolished it,” he said, while also criticizing the judiciary for questioning religious disputes and directing constitutional authorities such as Governors and the President.
Referring to Articles 141 and 368, Dubey emphasized that while the court can interpret laws, it cannot make them. He added, “How can you give directions to the appointing authority? The President appoints the Chief Justice of India. The Parliament makes the law. You will now dictate Parliament?”
Dubey claimed the court was pushing the country toward “anarchy” and demanded a larger discussion when Parliament reconvenes.
These remarks come amid Supreme Court hearings on multiple petitions challenging the constitutionality of the Waqf (Amendment) Act, 2025. On April 17, the Centre assured the top court it would not denotify any Waqf-by-user properties or appoint non-Muslim members to the Waqf Board—following the court’s indication that it may consider staying certain provisions of the law.
As tensions grow between key democratic institutions, the BJP leadership has officially distanced itself from Dubey and Sharma’s remarks. Party President JP Nadda has clarified that these are personal opinions and not endorsed by the party, reiterating the BJP’s respect for the judiciary. (ANI)
